These Terms describe the rules and responsibilities that apply when people use PropSked.

Agreement and scope

These Terms apply to visitors, landlords, property managers, prospects, and applicants who use PropSked. Using the service or creating an account indicates agreement to these Terms where that agreement applies.

PropSked is currently intended for use in Canada. Users must also comply with any mandatory laws that apply in their province or territory.

What PropSked does

PropSked provides software for rental listings, showing requests and scheduling, communications and reminders, rental applications, and landlord organization and review tools.

PropSked is not a landlord, property manager, tenant, applicant, real-estate brokerage, credit-reporting agency, legal adviser, or the person making a rental decision. PropSked does not make automated rental decisions.

Landlord and property-manager responsibility

Landlords and property managers remain solely responsible for their rental operations and decisions. PropSked remains responsible for its own service and privacy practices to the extent required by law.

PropSked must not be used to discriminate unlawfully, evade housing laws, or otherwise interfere with the rights of prospects, applicants, or tenants.

  • Keeping listings, showing availability, and communications accurate.
  • Deciding what information to request and having lawful authority and consent to collect it.
  • Using lawful screening criteria and complying with human-rights, anti-discrimination, and residential-tenancy laws.
  • Providing required notices and disclosures and making rental decisions.
  • Making lawful retention or deletion choices available to them.
  • Verifying information before relying on it.

Accounts and security

Users must provide accurate registration information, keep passwords and access links private, promptly report suspected compromise, and take responsibility for actions performed through their account. Credentials must not be shared where that sharing is unauthorized.

Public registration currently supports landlords and property managers only. This does not guarantee that any future account, invitation, or membership feature will be introduced.

Prospect and applicant information

Prospects and applicants may submit information through PropSked to a landlord or property manager. That landlord or property manager determines the rental purpose and makes the housing decision. PropSked does not verify every application answer or document.

Applicants should provide accurate information. Users must not upload unnecessary, illegal, malicious, or unrelated content. PropSked may remove or restrict content when reasonably necessary to protect the service, comply with law, or address abuse.

Communications

PropSked may send transactional emails about accounts, showings, applications, reminders, and access links. Email delivery is not guaranteed, so users remain responsible for directly confirming time-sensitive matters when necessary.

Managers must maintain accurate recipient information. No one may use PropSked to send abusive, deceptive, unlawful, or excessive communications.

Acceptable use

Users may use ordinary legitimate links and features for their intended purposes. The following conduct is prohibited:

  • Unauthorized access or attempts to circumvent access controls.
  • Malicious uploads, unauthorized scraping, or excessive automated requests.
  • Impersonation, fraud, harassment, or discriminatory use.
  • Unlawful collection or disclosure of information.
  • Interference with the service or uploading material without authority.

Third-party services and links

PropSked uses service providers and may link to external sites. External services have their own terms, privacy practices, and availability. PropSked does not guarantee third-party services.

Intellectual property and user content

PropSked retains its rights in its software, branding, and original interface materials. Users retain ownership of, and responsibility for, rental listings, applicant documents, and other content they submit.

Users give PropSked the limited permission needed to host, process, display, transmit, back up, and otherwise operate the service using their content. Users confirm that they have authority to submit that content.

Service availability and changes

Features may change, and maintenance or outages may occur. PropSked does not promise uninterrupted or error-free availability. Users should not treat data in PropSked as their only legally required record.

Paid features may be introduced later, but no charge will be imposed without appropriate notice and agreement.

Suspension and termination

PropSked may restrict or suspend access where reasonably necessary because of a security risk, abuse, illegal use, a material breach of these Terms, risk to applicants, prospects, users, or the service, or a legal requirement.

The effect of a company suspension remains subject to future product rules. Suspension or termination does not mean that all related data will always be deleted immediately.

Disclaimers

PropSked is provided on an "as available" basis. PropSked does not guarantee applicant suitability, information accuracy, email delivery, tenancy outcomes, legal compliance by users, or uninterrupted operation.

PropSked does not provide legal advice. Users should obtain appropriate professional advice. Nothing in these Terms excludes warranties, rights, or responsibilities that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, PropSked will not be liable for indirect, incidental, special, or consequential losses arising from use of, or inability to use, the service where those losses may lawfully be excluded.

This qualified limitation preserves mandatory statutory rights and does not exclude liability for fraud, wilful misconduct, or any responsibility that cannot lawfully be excluded. No fixed monetary cap applies in this draft.

Indemnity

To the extent permitted by law, a user is responsible for third-party claims arising from that user's unlawful use, submitted content, discrimination or housing-law violations, breach of these Terms, or lack of authority to collect or disclose information. This clause applies only to the extent the claim results from the user's conduct.

Governing law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without limiting any mandatory rights or laws that apply in another jurisdiction.

Changes and contact

These Terms are effective on the date and under the version shown above. Changes may be posted from time to time, and material changes may require renewed acceptance later.
